The short version

  • Grapevine is a do-it-yourself document tool. We are not a law firm, and we don’t give legal advice.
  • Answering questions and previewing your document is free. You pay once to download or print it. There is no subscription.
  • You are responsible for your answers, for reading your documents, and for signing them the way your state requires.
  • Your answers are saved in your own web browser, not on our servers. Keep copies of your finished documents.
  • Nevada law governs these terms.

1.Agreement to these terms

These Terms and Conditions (the “Terms”) are an agreement between you and Grapevine Docs, Inc. (“Grapevine,” “we,” “us”). They apply to the Grapevine website and every document tool, form and article on it (together, the “Service”).

You accept these Terms when you use the Service, and again when you tick the box agreeing to them before you pay. Ticking that box is your electronic signature, with the same effect as signing on paper. If you do not agree, please do not use the Service.

2.Not a law firm; no legal advice

Grapevine is a self-help document preparation service. We are not a law firm, and neither the Service nor anyone at Grapevine gives you legal advice, reviews your answers for legal sufficiency, recommends which documents you need, or applies the law to your situation.

Using the Service does not create an attorney-client relationship between you and Grapevine, or between you and any attorney who helped write, or who owns or works for, Grapevine. You are representing yourself.

Our documents are general forms written to work for many people. They are not tailored to your circumstances and may not suit situations such as a large or taxable estate, a business, property in more than one state or country, a beneficiary with special needs or who receives public benefits, Medicaid or long-term-care planning, a blended family with competing interests, or an expected challenge to your plan. If any of these apply to you, or if you are unsure, talk to a licensed attorney in your state.

The law differs from state to state and changes over time. We work to keep our documents and articles current, but we cannot promise that every document, instruction or article reflects the latest law in your state.

3.Who may use Grapevine

You may use the Service only if you are at least 18 years old and legally able to enter into a contract and to make the documents you create. You may prepare documents for yourself, and, if you are completing documents as a couple, for your spouse or domestic partner, but only with their knowledge and permission. Each person must read and sign their own documents.

You may not use the Service to prepare documents for someone else as a paid service or on a commercial basis.

4.How Grapevine works

You answer plain-language questions, and the Service fills your answers into a document template. You can answer questions and preview your document for free. The free preview is marked “SAMPLE” and is not for signing. When you pay, you can download and print the finished document without the sample marking.

Signing instructions, checklists and articles on the Service are general information only. Requirements for signing, witnessing, notarizing, recording and funding documents vary by state and can change, so confirm them for your state.

A trust document or Schedule A does not by itself transfer property into your trust. Real estate usually needs a new deed, and accounts usually need to be retitled or given a beneficiary designation. Those steps are yours to complete.

5.Your responsibilities

You are responsible for:

  • the accuracy and completeness of every answer you give, including names, addresses and descriptions of property;
  • reading every finished document carefully before you sign it, and not signing anything you do not understand or agree with;
  • signing each document in the way your state requires, including any witnesses or notary, and on time;
  • keeping your original signed documents somewhere safe and telling the right people where to find them;
  • reviewing and updating your documents when your life or the law changes, for example after a marriage, divorce, birth, death or move to another state.

We do not check your answers for errors or legal effect, and we are not responsible for a document that fails because of inaccurate answers, improper signing, or a change in your circumstances or the law.

6.Prices, payment and delivery

Prices are shown on our pricing and checkout pages in U.S. dollars. Each purchase is a one-time payment for the plan, package or document you choose. There are no subscriptions or automatic renewals. We may change our prices at any time, but a change does not affect a purchase you have already made.

Payments are processed by Stripe, Inc., on Stripe’s secure payment page. We never see or store your full card number. Stripe’s own terms and privacy policy also apply to your payment.

Your purchase is delivered digitally, right after payment, by unlocking download and printing for the documents you bought in the web browser you used. Because there are no customer accounts at this time, your purchase is remembered only in that browser. If you change devices or clear your browser data, contact us with your payment receipt and we will help you regain access. Please save and back up your downloaded documents.

7.Refunds

Because your documents are delivered to you in full the moment you pay, all sales are final, except that we will refund you if:

  • you were charged more than once for the same purchase;
  • you were charged the wrong amount; or
  • a technical problem on our side prevents you from downloading the documents you paid for, and we cannot fix it within a reasonable time.

Ask for a refund by contacting us within 30 days of your purchase with your payment receipt. We may also give a refund in other situations at our discretion. This section does not limit any right to a refund that the law of your state gives you.

8.Your information

The answers you type into our document tools are saved in your own web browser on your device. They are not sent to or stored on our servers. Anyone who uses your device and browser may be able to see them, so use the “Start over” button, or clear your browser data, when you are finished on a shared device.

When you pay, Stripe collects your payment details, name and email address and shares a record of the purchase with us. After payment, your browser sends Stripe’s receipt number to a service we run on Cloudflare, only to confirm that the payment is genuine. Our website is hosted by GitHub and uses web fonts from Google, and those providers may receive technical information such as your IP address when you visit.

Grapevine is not a health care provider or other “covered entity” under HIPAA. Health care directives and HIPAA authorizations you create are your own documents.

9.License and ownership

The Service, including its software, document templates, wording, articles, design and logos, belongs to Grapevine and is protected by copyright and trademark law.

When you buy a document, you may use, copy, print, sign and share it for your own personal, family or household purposes, including giving copies to the people and institutions who need them, such as your agents, trustees, family, doctors, banks and attorneys. You may not sell, publish or redistribute our templates or documents, or use them to prepare documents for others as a business.

10.Acceptable use

You agree not to:

  • get around, disable or interfere with our payment process or any feature that limits downloading or printing to paying customers;
  • copy, scrape or extract our templates or content in bulk, or reverse-engineer the Service;
  • use the Service for anything unlawful, fraudulent or harmful, including preparing a document for someone without their knowledge or against their wishes; or
  • interfere with the Service, its security, or other people’s use of it.

We may refuse service, or block access to the Service, for anyone who breaks these Terms.

11.No warranties

To the fullest extent the law allows, the Service and all documents, forms and information on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that any document will achieve a particular legal result, be accepted by any court, institution or person, or that the Service will be uninterrupted or error-free.

12.Limitation of liability

To the fullest extent the law allows, Grapevine and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of property, inheritance, data or opportunity, arising from or related to the Service or any document prepared with it. Our total liability for any claim related to the Service is limited to the amount you paid us for the purchase the claim relates to.

Some states do not allow certain limits on warranties or damages, so some of the limits above may not apply to you.

13.Indemnity

You agree to reimburse Grapevine for reasonable losses and costs, including reasonable attorney’s fees, that result from your breaking these Terms or misusing the Service, including a claim by another person that arises from a document you prepared with inaccurate information or without their permission.

14.Governing law and disputes

These Terms, and any dispute related to them or the Service, are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules.

If you have a concern, please contact us first. Most issues can be resolved quickly and informally. If we cannot resolve it within 30 days, either of us may bring the dispute in small claims court, if it qualifies, or otherwise in the state or federal courts located in Clark County, Nevada, and you and we agree to the jurisdiction of those courts. Any claim must be brought individually, not as a class or representative action, to the extent the law allows.

15.Changes to these terms

We may update these Terms from time to time. We will post the new version on this page with a new “last updated” date. The version in effect when you make a purchase applies to that purchase. Continuing to use the Service after a change means you accept the updated Terms.

16.General

These Terms are the entire agreement between you and Grapevine about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. You may not transfer your rights under these Terms, but we may transfer ours to a successor to our business.
